1. Overview
Welcome to The Good Aunty Pty Ltd. In these Terms of Service, The Good Aunty, we, us and our means The Good Aunty Pty Ltd.
These Terms of Service apply to your access to and use of our website, online store, and any related content, features, tools, products and services we make available through them (Services).
Our store is hosted on Shopify, which provides the ecommerce platform that enables us to offer our Services to you. However, any sale of goods or services through our store is made by The Good Aunty, not Shopify.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, available at www.thegoodaunty.com.au/policies/privacy-policy. If you do not agree, you must not use our Services.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law where those rights cannot legally be excluded, restricted or modified.
2. Eligibility and Accounts
By using our Services, you confirm that you are legally capable of entering into a binding agreement. If you are under 18 years of age, you may only use the Services with the involvement and consent of a parent or legal guardian.
You may be required to provide information such as your name, email address, billing address, shipping address and payment details in order to use parts of the Services or place an order. You agree that any information you provide is accurate, current and complete.
You are responsible for maintaining the confidentiality of your account details and for all activity conducted through your account, except to the extent caused by our acts or omissions or those of our service providers.
You must not transfer, sell, assign or otherwise deal with your account without our prior written consent.
3. Products and Product Information
We try to ensure that all descriptions, images, prices and other information about products and services are accurate and up to date.
However:
- product images are for illustrative purposes only;
- colours and appearance may vary depending on your device and screen settings; and
- minor differences in packaging or presentation may occur from time to time.
We may update, withdraw or change products, prices, descriptions or specifications at any time, subject to applicable law.
Nothing in this section limits your rights under the Australian Consumer Law, including any applicable consumer guarantees.
4. Orders
When you place an order through our store, you are making an offer to purchase the relevant product or service.
A contract is only formed when we accept your order and send you confirmation of that acceptance. We may decline an order before acceptance for legitimate reasons, including where:
- the product is unavailable;
- there is an error in pricing or product information;
- we reasonably suspect fraud or unlawful activity; or
- we cannot process payment.
If we cancel an order after payment has been processed, we will refund the amount paid for that order as soon as reasonably practicable.
You must check your order carefully before submitting it. If you need to change or cancel an order, contact us promptly using the contact details listed below. We cannot guarantee that changes or cancellations can be made once an order has been submitted or processed.
Your rights to refunds, repairs, replacements or cancellations may also arise under our Refund Policy and under the Australian Consumer Law.

You agree that you are purchasing products for personal, domestic or household use unless we agree otherwise in writing.
5. Prices, Payment and Billing
All prices shown on our website are in Australian dollars (AUD) unless otherwise stated.
All prices displayed are inclusive of GST where applicable.
Shipping charges, delivery fees and any other applicable charges will be shown at checkout or before you confirm your order.
If you order from outside Australia, your order may be subject to customs duties, taxes or import charges imposed by the destination country. These charges are your responsibility unless we state otherwise.
You agree to provide current, complete and accurate purchase and account information for all purchases made through our Services.
If a payment is declined or reversed, we may refuse to process the order and/or suspend delivery until payment is successfully received.
We reserve the right to correct genuine pricing errors. If there has been an obvious pricing mistake and you have already placed an order, we will contact you before processing the order or issue a full refund if processing cannot proceed on the correct price.
6. Shipping and Delivery
We will arrange delivery in accordance with the delivery option selected at checkout.
Any delivery times we provide are estimates only and are not guaranteed, although we will take reasonable steps to dispatch orders within the timeframes we communicate.
Delays may occur due to events outside our reasonable control, including carrier delays, supply disruptions, severe weather or customs processing.
For consumer sales, risk in goods passes to you on delivery to your nominated address or when you or your authorised representative takes physical possession of the goods, except where applicable law provides otherwise.
Title to goods passes to you once we have received payment in full and the goods have been delivered, unless applicable law requires otherwise.
If your order arrives damaged, is lost in transit, or you believe there is an issue with delivery, please contact us as soon as possible using the contact details listed below.
Nothing in this section affects your rights under the Australian Consumer Law.
7. Returns, Refunds and Exchanges
Our returns, refunds and exchanges are governed by our Refund Policy available at www.thegoodaunty.com.au/policies/refund-policy.
That policy is in addition to, and does not limit, any rights you may have under the Australian Consumer Law.
Under the Australian Consumer Law, consumers may be entitled to a repair, replacement or refund, and to compensation for other reasonably foreseeable loss or damage, where goods or services fail to meet a consumer guarantee.
We do not provide refunds for change of mind unless stated in our Refund Policy or otherwise required by law.
8. Intellectual Property
Unless otherwise indicated, all content made available through the Services, including text, graphics, logos, icons, images, videos, audio, software, layout, design, branding and other materials, is owned by or licensed to The Good Aunty and is protected by Australian and international intellectual property laws.
You may access and use the Services for your personal, non-commercial use only.
You must not, without our prior written consent except as permitted by law:
- reproduce, copy, modify, distribute, communicate, display, publish or exploit any part of the Services;
- create derivative works from any content on the Services; or
- use our trade marks, business names or branding.
All other trade marks appearing on the Services belong to their respective owners.
9. Third-Party Tools, Platforms and Links
Our Services may include access to third-party tools, plug-ins, integrations, websites or content, including services provided by Shopify.
To the extent permitted by law, we do not control and are not responsible for third-party services, websites or content, including their availability, accuracy, security or privacy practices.
Your use of third-party services may be subject to separate terms and privacy policies imposed by those third parties, and you should review them before using those services.
Nothing in this section excludes any liability that cannot legally be excluded.
10. Shopify's Role
Our store is powered by Shopify, which enables us to provide the Services to you. However, any purchases you make through our online store are transactions between you and The Good Aunty.
To the extent permitted by law, Shopify is not responsible for the products sold by The Good Aunty or for the fulfilment of sales between you and us.
11. Privacy
We collect, use and disclose personal information in accordance with our Privacy Policy, available at www.thegoodaunty.com.au/policies/privacy-policy.
Because our store is hosted by Shopify and we use third-party service providers, personal information you provide through the Services may be collected, stored, processed or disclosed by Shopify and other service providers, including overseas recipients.
By using the Services, you acknowledge that your personal information will be handled as described in our Privacy Policy.
If you are an Australian customer, our handling of personal information is intended to comply with the Privacy Act 1988 (Cth) to the extent applicable to our business.
12. Reviews, Submissions and Feedback
If you submit reviews, comments, suggestions, ideas, images, testimonials or other content to us (User Content), you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, publish, adapt and display that User Content for the purpose of operating, marketing and improving our business and Services.
You represent that:
- you own or have the necessary rights to submit the User Content;
- the User Content is accurate, lawful and not misleading; and
- the User Content does not infringe the rights of any person.
We may remove or decline to publish User Content where we reasonably believe it is unlawful, misleading, offensive, defamatory, infringes rights, or breaches these Terms.
We are not obliged to keep User Content confidential, pay compensation for it, or publish it.
13. Errors and Inaccuracies
Occasionally there may be errors, inaccuracies or omissions in product descriptions, pricing, promotions, offers, shipping information, transit times or availability.
We reserve the right to correct those errors and to update information or, where necessary, cancel orders affected by a genuine error. If this occurs after you have placed an order, we will notify you and, where applicable, provide an appropriate refund or the option to proceed on the corrected terms.
Nothing in this section limits your rights under the Australian Consumer Law.
14. Acceptable Use
You must not use the Services:
- for any unlawful purpose;
- to commit fraud or facilitate fraudulent activity;
- to infringe our rights or the rights of others;
- to upload or transmit viruses, malware or malicious code;
- to interfere with the security, functionality or operation of the Services;
- to use false identity details or impersonate another person; or
- to scrape, harvest or collect personal information from the Services without authority.
You must not use bots, crawlers, automated systems or similar technologies to access the Services in a way that unreasonably burdens the Services, circumvents security measures, or is otherwise unauthorised by us.
We may suspend or restrict access where we reasonably believe you have breached these Terms, engaged in fraud or misuse, or created security or legal risk.
15. Automated Agents
If you use any automated agent, bot or similar software to access or interact with the Services, you must ensure that the agent:
- complies with these Terms;
- does not misrepresent itself as a human user;
- does not bypass access controls, robot exclusion measures, CAPTCHAs or security protections; and
- stops accessing the Services if we request that it do so.
We may use technical or other measures to restrict or prevent automated access to the Services.
16. Suspension and Termination
We may suspend, limit or terminate your access to the Services where reasonably necessary, including if:
- you materially breach these Terms;
- we reasonably suspect fraud, unlawful conduct or misuse;
- it is necessary to protect our systems, customers or business; or
- we are required to do so by law.
Where appropriate, we may give you notice and an opportunity to remedy the issue, unless the issue is serious, urgent, unlawful, or creates immediate risk.
Termination does not affect any accrued rights or liabilities.
The following sections survive termination to the extent relevant: Intellectual Property, Privacy, Liability, Indemnity, Governing Law, and any other provisions intended by their nature to survive.
17. Consumer Guarantees and Service Standards
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory guarantee or other right or remedy you may have under applicable law, including the Australian Consumer Law.
Where goods or services supplied by us are not ordinarily acquired for personal, domestic or household use or consumption, our liability for breach of any non-excludable guarantee may, where permitted by section 64A of the Australian Consumer Law, be limited at our option to:
- in the case of goods: replacement of the goods, repair of the goods, payment of the cost of replacing the goods, or payment of the cost of having the goods repaired; and
- in the case of services: resupply of the services or payment of the cost of having the services supplied again.
18. Disclaimers
To the extent permitted by law, we do not guarantee that the Services will always be uninterrupted, secure or error-free, or that all information on the Services will always be current, complete or free from errors.
The Services are provided on an "as available" basis, subject to any rights you have under law, including the Australian Consumer Law.
Any general information provided through the Services is for information purposes only and is not professional advice.
19. Limitation of Liability
To the maximum extent permitted by law, and subject to any rights that cannot be excluded under law:
- we are not liable for indirect, incidental, special or consequential loss;
- we are not liable for loss of profits, loss of revenue, loss of opportunity, loss of goodwill or loss of data; and
- we are not liable for delay or failure to perform to the extent caused by events outside our reasonable control.
Nothing in these Terms excludes or limits liability for:
- rights and remedies you have under the Australian Consumer Law;
- fraud, wilful misconduct or gross negligence where liability cannot legally be excluded; or
- any other liability that cannot legally be excluded or limited.
Where liability cannot be excluded but can be limited, our liability is limited to the fullest extent permitted by law.
20. Indemnity
You agree to indemnify us for loss we suffer arising from your unlawful use of the Services, your breach of these Terms, or your infringement of any third-party rights, except to the extent the loss was caused or contributed to by our negligence, wrongful act or breach of these Terms.
This section does not apply to any consumer rights or remedies that cannot lawfully be excluded.
21. Force Majeure
We are not responsible for delay or failure to perform our obligations to the extent caused by events outside our reasonable control, including natural disasters, pandemics, strikes, transport disruptions, supplier failures, telecommunications outages or government action.
We will take reasonable steps to minimise the effect of such events where practicable.
22. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.
23. Waiver
A failure or delay by us to exercise a right under these Terms does not constitute a waiver of that right.
24. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies expressly incorporated by reference, form the entire agreement between you and us regarding your use of the Services.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations under these Terms as part of a business restructure, sale, transfer of assets, merger or other corporate transaction. If that occurs, your rights under these Terms will not be materially reduced.
26. Governing Law
These Terms are governed by the laws of South Australia, Australia.
You submit to the non-exclusive jurisdiction of the courts of South Australia and the Commonwealth of Australia.
27. Changes to These Terms
We may update these Terms from time to time.
If we make a material change, we will publish the updated Terms on our website and may also provide additional notice where required by law.
The updated Terms will apply from the date they are posted or from any later effective date stated in the Terms. If you continue to use the Services after that date, you will be taken to have accepted the updated Terms, to the extent permitted by law.
